Booking Conditions

HOTEL BOOKINGS

Cancellation Policy

  • Cancellation 11 days prior to arrival: 100% refund of booking amount.
  • Cancellation 7-11 days prior to arrival: 50% refund of booking amount.
  • Cancellation within 7 days of arrival: No refund.

All cancellations/refunds will be processed after deducting GST.

Bookings via third-party platforms (like Airbnb, Make My Trip, Goibibo) will follow the respective platform’s cancellation/refund terms.

Terms & Conditions
  • Check-in time: 1 PM | Check-out time: 11 AM.
  • Rooms are held until 6 PM on the day of arrival unless informed of late arrival.
  • Early check-in and late check-out subject to room availability.
  • Prices subject to change without prior notice.
  • GST applies as per Government of India regulations.
  • Maximum occupancy: 3 adults or 2 adults with 2 children (below 5 years) per room.
  • Extra mattress available for additional adult/child per room.
  • NRIs/Foreigners must show their passport at check-in.
  • Indian citizens must show a valid photo ID at check-in.
  • Credit card bookings require the card used for booking at check-in. If using another’s card, provide a copy of the card and a no-objection letter signed by the card owner at check-in.
  • Pema’s Cottage reserves the right to cancel the booking if identity verification fails due to lack of proper documents or false documents. No refund in such cases.

TOURS

Booking Policy

  • To secure your spot on the tour, a 25% deposit of the total cost is required.
  • The remaining 75% of the total cost must be paid by the participants no later than 45 days prior to the chosen departure date.
  • Not following these guidelines may lead to the cancellation of your booking.

Cancellation Policy

  • Cancellation 60 days prior to the start date: 10% of the trip cost will be charged as a cancellation fee.
  • Cancellation within 60-45 days prior to the start date: 21% of the trip cost will be charged as a cancellation fee.
  • Cancellation within 45-26 days prior to the start date: 50% of the trip cost will be charged as a cancellation fee.
  • Cancellation within 26 days prior to the start date: 100% of the trip cost will be charged as a cancellation fee.
  • If Outback Escapes cancels the trip due to unavoidable circumstances: 100% of the trip cost will be refunded.
  • If the trip is canceled due to weather-related reasons at any time before the start date: We will attempt to refund as much as possible or adjust the amount in the next trip.

Child Policy

  • Children aged 0-4 years are not allowed on OE trips.
  • Children aged 5-10 years receive up to a 16% discount on the trip cost.
  • Travelers must bear the cost of a child safety seat (if applicable) and the child’s insurance.
  • Children aged 11 years and above will be charged 100% of the trip cost.

Thank you for choosing us for your adventure. This agreement outlines the terms and policies for our expeditions to ensure a safe and enjoyable experience. By booking with us, you agree to these terms.

Terms of Purchase

  • This agreement details the terms of your booking for our expeditions.
  • Your booking is confirmed once we receive your deposit and provide written confirmation.
  • The agreement lasts from the time of booking until one day after the expedition ends.

Outback Escapes Obligations

  • We provide motoring expeditions worldwide.
  • We arrange accommodations, vehicle rentals, and some meals, subject to availability.

Customer Obligations

  • You must respond promptly to our requests for information and approvals.
  • Failure to comply may result in the cancellation of your booking or participation in select activities.

Customer Documents

  • You must provide all necessary travel documents and identification.
  • You are responsible for obtaining and carrying these documents.
  • We are not responsible for errors in travel or medical documentation.

Accurate Information

  • Ensure all information provided is correct and complete.
  • Report any errors immediately.

Rescheduling

  • We may offer future travel credits instead of refunds, at our discretion.
  • Credits must be used within one year of the original departure date.

Medical Requirements

  • Complete and submit medical forms as requested.
  • Inform us of any pre-existing medical conditions.

Health Requirements

  • Assess your fitness for the planned activities.
  • Understand that medical facilities may be limited in remote areas.
  • We may prohibit participation if your health poses a risk.

VEHICLE RENTAL

  • Vehicle Rental Agreement: Outback Escapes uses motor vehicles from local fleet rental companies (the “Vehicle”). You consent to sign the vehicle rental agreement provided by the vehicle rental company.
  • Driver’s License Requirements: By booking the tour, you declare that you have a valid driver’s license and, if applicable, an international driving permit valid in the tour regions. You further declare that your licenses are in good standing, and you possess reasonable driving skills and confidence for the tour.
  • Vehicle Condition Check: Upon receiving your vehicle, you must check its condition. If you find any defects, inform the Outback Escapes representative immediately for a joint examination. Amendments should be made and countersigned by both parties. Return the vehicle in the same condition as at the start of the tour. You are responsible for any repair or refurbishment costs. Alternative vehicles provided by Outback Escapes are subject to availability.
  • Maintenance and Fuel: During the rental period, you must perform usual checks (e.g., engine oil level, tire pressure) and respect the vehicle’s maintenance cycle. Stop the vehicle if any warning lights indicate a mechanical problem and inform Outback Escapes immediately. You are responsible for refueling the vehicle with the correct fuel at your expense unless otherwise notified in writing.
  • Vehicle Security: Always lock the vehicle and use its alarm and/or immobilization equipment when parked, even briefly. Never leave the vehicle unoccupied with the keys in the ignition.
  • Mechanical Issues: If the vehicle becomes unroadworthy or unfit for normal use during the tour due to a breakdown or accident, inform Outback Escapes immediately. Repair costs without Outback Escapes’ order will not be reimbursed. Report all accidents or damage to Outback Escapes. Neither Outback Escapes nor its employees are liable for any loss or damage (including loss of profit or earnings) or indirect consequential damages.
  • Third-Party Measures: If the vehicle is subject to attachment, theft, confiscation, or impounding (the “Confiscation”), inform Outback Escapes immediately. You are liable for all damages, costs, and/or expenses associated with the Confiscation unless directly caused by Outback Escapes. Confiscation or an accident may result in termination of the vehicle rental agreement. Outback Escapes is not obligated to provide a new vehicle.
  • Personal Belongings: Outback Escapes is not responsible for any loss, theft, robbery, or damage to objects and/or personal belongings in the vehicle.
  • Care and Responsibility: Ensure the vehicle is handled with care, kept in good repair, and only driven by you or authorized individuals. You are responsible for any fines and must reimburse Outback Escapes for any damages or expenses incurred due to your handling of the vehicle.
  • Prohibited Uses: The vehicle must be used responsibly and only for intended purposes. Prohibited uses include:
    • Driving under the influence of alcohol, drugs, or narcotic substances.
    • Transporting inflammable or dangerous goods.
    • Allowing unauthorized individuals to operate the vehicle.
    • Assigning the rental agreement to another party.
    • Carrying passengers for hire or reward.
    • Providing driving lessons.
    • Pushing or towing other vehicles or objects.
    • Exceeding authorized load weight.
    • Driving on unmarked roads or outside the planned route.
    • Violating local traffic laws.
  • Offenses: You are liable for any offense committed during the tour relating to the vehicle’s use and must comply with all legal requirements.
  • Insurance Policy: You must abide by the vehicle rental company’s insurance policy terms. Comprehensive international travel insurance with vehicle damage coverage is strongly advised.
  • Non-Compliance: Outback Escapes may remove you from driving or cancel your tour if you do not comply with these terms or the vehicle rental company’s terms.

DIETARY RESTRICTIONS

  • Dietary Requirements: Inform Outback Escapes of your dietary requirements two weeks prior to the departure date. Requests are subject to availability of products in the tour region.
  • Responsibility for Allergies: Outback Escapes is not responsible for requests made after the departure date or unreported allergies and dietary restrictions.

MEDIA RELEASE

  • Consent to Use Likeness: You consent to Outback Escapes, its representatives, and other participants capturing and using your likeness (voice and image in photos, video, and audio recordings) for promotional and commercial purposes during and after the tour without payment. Inform Outback Escapes in writing if you do not wish to be included in promotional material.
  • Media Material: You consent to Outback Escapes using any media material you share with them. All media material becomes the property of Outback Escapes. Outback Escapes may provide a copy of the media material to participants as a souvenir but is not obligated to do so.
  • Editing and Distribution: You consent to Outback Escapes editing, changing, copying, displaying, publishing, or distributing the media material for any lawful purpose.
  • Waiver of Compensation: You waive any right to royalties or compensation arising from the use of the media material.

BOOKING ON BEHALF OF OTHERS

  • Participant Requirement: You must be a participant and accept the agreement to book on behalf of others.
  • Responsibility: If you book for others, you ensure their compliance with the terms and obtain relevant consents. You are the primary contact and responsible for communicating information from Outback Escapes to other participants.
  • Authority to Accept: You guarantee authority to accept the agreement on behalf of others in your booking party.

UNAUTHORIZED ITEMS

  • Prohibited Items: You are prohibited from carrying dangerous or illegal items, including explosives, weapons, inflammable objects, and illegal substances.

INSURANCE

  • Comprehensive Coverage: Due to tour risks, comprehensive insurance coverage, including vehicle damage, medical, trip interruption, cancellation, emergency evacuation, and baggage insurance, is strongly advised. Minimum emergency evacuation and medical coverage of $500,000 USD is recommended.

DISCLAIMER

  • As-Is Services: Tours are provided “as is” without warranty. Outback Escapes disclaims warranties regarding the enjoyment of the landscape, accuracy of shared historical facts, cultural experiences, group size, sight-seeing of animals, weather, travel duration, and road conditions.
  • No Warranty of Risk-Free Tour: Outback Escapes disclaims any warranty that the tour will be uninterrupted or risk-free.

ASSIGNMENT

  • Transfer Restrictions: Outback Escapes restricts assignment or transfer of the contract without written agreement.

MODIFICATIONS

  • Agreement Modifications: Outback Escapes may modify the agreement. You will be notified of changes, and continued participation implies acceptance of the modified terms.

TERMINATION BY OUTBACK ESCAPES

  • Non-Compliance: Outback Escapes may terminate the agreement for non-compliance with terms, without a refund.
  • Group Size: Outback Escapes may cancel the tour if the group size requirement is not met, issuing a full refund and potentially reimbursing airline cancellation fees at their discretion.
  • Termination Notice: Termination will be communicated via email.

FORCE MAJEURE

  • Beyond Control Events: Outback Escapes is not responsible for delays, cancellations, or other issues due to circumstances beyond their control, including but not limited to acts of God, terrorism, civil disturbances, government actions, equipment failures, epidemics, fuel shortages, and extreme weather.

LIMITATION OF LIABILITY

  • Waiver of Claims: You agree that Outback Escapes and its affiliates are not liable for damages, expenses, delays, cancellations, or inconveniences caused by you, Outback Escapes, third-party providers, or force majeure events. You waive claims against Outback Escapes and affiliates for any damages and limit their liability to amounts paid by you.
  • Personal Property: Outback Escapes is not liable for loss or damage to valuables or personal property during the tour.
  • Tour Risks: You acknowledge the risks of the tour, including strikes, civil unrest, diseases, high altitude, dangerous weather, wild animals, physical exertion, and negligence. Comprehensive insurance is advised.
  • Medical Advice: You confirm having sought medical advice and assessed risks before participating in the tour.

NOTICES

  • Communication: Notices under this agreement shall be sent via email and are deemed received on the date sent. Changes in email addresses must be promptly communicated.
  • Contact Information: Notices to Outback Escapes should be sent to: info@outbackescapes.com.

WAIVER

  • Non-Enforcement: Failure to enforce any provision of this agreement does not waive the right to enforce it later.

SEVERABILITY

  • Invalid Provisions: Invalidity or unenforceability of any provision does not affect other provisions.

DISPUTE RESOLUTION

  • Good Faith Negotiations: Disputes will be subject to good faith negotiations for 26 days.
  • Arbitration: Unresolved disputes will be submitted to binding arbitration under the Commercial Arbitration Act with one arbitrator selected by Outback Escapes. Monetary damages are limited to amounts paid by you to Outback Escapes.

CHOICE OF FORUM

  • Jurisdiction: This agreement shall be governed by the laws of the State of Republic of India. Disputes shall be subject to the exclusive jurisdiction of the courts in Republic of India.

NON-DISPARAGEMENT

  • Reputation: You agree not to disparage Outback Escapes or its affiliates publicly or privately.

BINDING EFFECT

  • Successors and Assigns: This agreement is binding on and inures to the benefit of the parties, their heirs, executors, administrators, successors, and assigns.
